In the event a request is made to the Brunswick Sewer
District to provide aid in a potential emergency situation involving
another public or private wastewater system, the District may choose to
provide such emergency service, conditioned upon the following. |
| |
|
|
| |
1. |
The District will attempt to provide such services
and‑or make such repairs as it deems necessary, and to the extent it deems
necessary, to
prevent, limit or remedy the emergency situation. |
| |
|
|
| |
2. |
The provision of said aid is dependent on, and
limited to, the availability of District personnel and equipment. |
| |
|
|
| |
3. |
The Owner‑Operator of the system requesting
assistance will have made a best faith effort to address the situation and
determine that the assistance of the District is necessary, prior to
contacting the District. |
| |
|
|
| |
4. |
The
Owner‑Operator of the system requesting assistance will assist the
District in whatever manner deemed necessary by the District. |
| |
|
|
| |
5. |
The Owner of the system requesting assistance will
reimburse the District at the rates and conditions currently in use, as
set forth in a bill for the services provided. |
| |
|
|
| |
6. |
It is understood that billing rates established by
the District for such services may not necessarily be competitive with
services available in the commercial market. |
| |
|
|
| |
7. |
Services provided by the District may be limited to
dealing with the emergency situation only. Follow-up repairs or
maintenance will be the responsibility of the system Owner‑Operator. |
| |
|
|
|
It is understood that all decisions to respond to
such a request and the extent of any response is at the sole discretion of
the District, and that the District will be held harmless for any decision
it makes in such a matter.
The conditions stated here are intended as guidelines
to be followed in treating all requests consistently. That
notwithstanding, the General Manager shall be free to exercise judgment in
determining whether and how to respond.
