Recovery of Cost Relating to Industrial Discharge

  Pursuant to District Rules & Regulations Article II, Section 13, Harmful Wastes Prohibited, it shall be the policy of the Brunswick Sewer District as follows:
  •   When it is determined that a discharge to facilities of the District of a listed harmful waste or wastes has occurred, and
     
  •   When additional costs are incurred by the District and/pr its subcontractors, including but not limited to costs of interception, containing, removing, analyzing, reporting, and disposing of the listed harmful waste, in an environmentally sound manner, in accordance with federal, state, local, and/or District regulations, and
     
  •   When investigation into circumstances surrounding the discharge reveals that the source of the listed harmful waste can reasonably be attributed to a specific user of District facilities,
     
  •   Then it shall be the policy of the District to pursue recovery in full, or to such lesser amount as the District, in its sole discretion, deems equitable, from the specific user of District facilities attributed to be responsible for the discharge, of the additional costs incurred by the District and/ or its subcontractors.
